These Terms apply to all visitors, users, winery members, and others who access or use the Site. We reserve the right to update or modify these Terms at any time. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. The date of the most recent revision is noted at the top of this page.

We reserve the right to modify, suspend, or discontinue any aspect of the Site or our services at any time without notice or liability.
You must be at least 21 years of age to use this Site. By using the Site, you represent and warrant that you are at least 21 years old and that you have the legal capacity to enter into these Terms. If you are using the Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
Account Registration. To access certain features, including claiming a winery listing or joining as a member, you may be required to provide information about yourself or your winery. You agree to provide accurate, current, and complete information and to update that information as necessary.
Winery Listings. By claiming or submitting a winery listing, you represent that you are authorized to act on behalf of the winery and that the information you provide is accurate. You grant us a non-exclusive, royalty-free license to display your winery's name, description, logo, images, and other submitted content on the Site and in our marketing materials.
Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately via the contact form at cawineassociation.com/contact if you suspect unauthorized use of your account.
Termination. We reserve the right to suspend or terminate your account or listing at our discretion if we believe you have violated these Terms or if your listing contains inaccurate, misleading, or inappropriate content.
Membership Plans. We offer various membership tiers for wineries and wine enthusiasts. The features, pricing, and terms of each membership plan are described on the Membership page of the Site and are subject to change.
Billing. By enrolling in a paid membership, you authorize us to charge your payment method on a recurring basis at the frequency specified at the time of enrollment (monthly or annually). All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
Cancellation. You may cancel your membership at any time. Cancellation will take effect at the end of the current billing period. You will retain access to membership benefits through the end of the paid period.
Price Changes. We reserve the right to change membership pricing at any time. We will provide at least 30 days' notice of any price increase before it takes effect for existing members.
Your Content. The Site may allow you to submit reviews, tasting notes, forum posts, comments, and other content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute your User Content in connection with the Site and our services.
Content Standards. You agree that your User Content will not: be false, misleading, or defamatory; infringe any third-party intellectual property rights; contain unlawful, abusive, harassing, or obscene material; constitute spam or unauthorized advertising; or violate any applicable law or regulation.
Moderation. We reserve the right, but are not obligated, to review, edit, or remove any User Content at our discretion. We are not responsible for any User Content posted by users of the Site.
Our Content. All content on the Site that is not User Content — including text, graphics, logos, images, audio, video, and software — is owned by or licensed to the California Wine Association and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.
Trademarks. "California Wine Association" and our logo are trademarks of the California Wine Association. You may not use our trademarks without our prior written consent.
Feedback. If you provide us with feedback, suggestions, or ideas about the Site or our services, you grant us the right to use that feedback without restriction or compensation to you.

We do not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party websites. Your use of third-party websites is at your own risk and subject to their terms and policies.
We use third-party services for analytics, advertising, payment processing, and other functions. Your use of the Site is subject to the terms and privacy policies of those third-party services where applicable.
As-Is Basis. The Site and all content and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Accuracy. While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, completeness, or reliability of any content on the Site, including winery listings, event information, or educational content. Winery listings are submitted by third parties and we do not independently verify their accuracy.
Alcohol. The California Wine Association is an informational and community platform. We do not sell alcohol. Any purchase of wine or other alcoholic beverages made through links on our Site is a transaction between you and the winery or retailer. You are responsible for complying with all applicable laws regarding the purchase and consumption of alcohol in your jurisdiction.
To the fullest extent permitted by applicable law, the California Wine Association and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising out of or related to these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless the California Wine Association and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Sonoma County, California, and you consent to the personal jurisdiction of those courts.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the California Wine Association regarding your use of the Site.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
